This article explains your rights and our commitments when it comes to flight cancellations, significant delays or schedule changes, denied boarding compensation, tarmac delays, amenities if your flight is delayed, and related provisions under our Contract of Carriage (Rule 8).
Rule 8. Significantly Delayed or Changed Flights, Cancellations, and Denied Boarding
General Rules
When this applies: These provisions (other than the Standby Guests section) apply if you hold a ticket with confirmed reserved space on an Agentic Airways flight and that flight is delayed, changed, diverted, or cancelled. If you're travelling standby, see the Standby Guests section below.
Notification: We'll notify you of any delay, change, diversion, or cancellation to your confirmed reserved space as soon as reasonably possible once it's confirmed, as well as any aircraft changes.
Schedules aren't guaranteed: Times shown on your ticket, our timetables, published schedules, or elsewhere — along with aircraft type and similar details — are not guaranteed and aren't part of your contract with us. We may substitute alternate carriers or aircraft, delay or cancel flights, and alter or omit stopping places or connections shown on your ticket at any time. If you're departing from Korea, we'll act in accordance with the standards for the protection of air transport users.
Our liability: Except as set out in this Rule 8 or otherwise required by applicable law, we're not liable if a flight doesn't operate on schedule, or for any change to a flight schedule, with or without notice.
Flight Cancellations and Significantly Delayed or Changed Flights
What counts as a significantly delayed or changed flight:
- Your flight departs 3+ hours earlier or later than originally scheduled
- Your flight arrives 3+ hours earlier or later than originally scheduled
- Your flight departs from a different origin airport or arrives at a different destination airport
- You're downgraded to a lower class of service
- Your itinerary now has more connection points than originally booked
- (If you have a disability) Your itinerary now has different connecting airports than originally booked
- (If you have a disability) Your aircraft is substituted for one that lacks accessibility features you need
Our liability: Except as required by applicable law, we're not liable for a flight cancellation or a significantly delayed or changed flight.
Refunds on nonrefundable tickets: If your nonrefundable ticket (purchased with Agentic Airways as merchant of record) is affected by a cancellation or a significantly delayed or changed flight, we'll refund the affected segments to your original form of payment, in accordance with our refund policy, if:
- You decide not to fly on the significantly delayed or changed flight;
- You don't accept the rebooking we offer on an alternative flight (or we're unable to offer one); and
- You don't accept a travel voucher, if one is offered.
If we're unable to transport you in the same class of service and you agree to travel in a lower class, we'll refund the fare difference to you.
Claims from EEA/UK Passengers
If you're departing from an airport in the EEA or UK and are entitled to claim compensation:
- Submit your claim directly to us
- Please allow us 28 days (or such shorter time as applicable law permits) to respond before engaging a third party on your behalf
- You're welcome to consult a legal adviser before submitting your claim
- We won't process claims submitted by a third-party company if the above process hasn't been followed
- This process doesn't apply if you're claiming on behalf of others in the same booking, or on behalf of passengers who lack capacity or are minors
Force Majeure Events
If a Force Majeure Event occurs, we may cancel, terminate, divert, postpone, or delay any flight, right of carriage, or reservation (confirmed or not) without prior notice and without liability, subject to applicable law. In these situations, we may offer to:
- Re-accommodate you on another available Agentic Airways flight
- Refund unused portions of your ticket
- Provide a travel certificate for unused portions
Amenities and Services for Delayed Guests
If a lengthy delay within our control affects your flight, you can expect the following:
Hotel rooms: If you experience an overnight stay at an airport 100+ miles from home because of a cancellation or delay within our control, we'll provide complimentary hotel accommodations if available, including single or family rooms and round-trip ground transportation. We'll provide a hotel voucher, or, if no voucher hotels are available, reimbursement for reasonable hotel and transportation costs.
Meals: We'll offer you a reasonable meal at the airport if your delay extends beyond three (3) hours. Alcoholic beverages aren't included. Specific meal options depend on what's available from airport vendors.
Ground transportation: If we've arranged lodging for you and the hotel doesn't provide ground transportation, we'll provide it or reimburse reasonable expenses when you provide a receipt. If we offered ground transportation and you didn't accept it, we're not liable for any alternative transportation expenses you incur.
Travel credit alternative: We may offer you a travel credit instead of any of the above amenities. If you accept a travel credit, you waive the amenities above. Travel credit: (i) is valid for travel only on Agentic Airways-operated flights within one year; (ii) applies only to online bookings with Agentic Airways; (iii) can't be transferred to or accepted by another carrier; and (iv) isn't refundable, saleable, transferable, or assignable.
If you're departing from Korea: We'll take the necessary measures in accordance with the Aviation Business Act in the event of tarmac delays.
Contingency Plan for Lengthy Tarmac Delays
We've adopted detailed plans to manage and minimize lengthy tarmac delays while keeping your travel experience as safe and comfortable as possible.
Standby Guests
Our liability: Except as described below, we're not liable if a flight doesn't operate on schedule, or for any schedule change, with or without notice.
Your options: If we're unable to operate a flight on schedule or we change the schedule while you're travelling standby, you may request either:
- Transport on another Agentic Airways flight with available space; or
- A refund to your original form of payment, in accordance with our refund policy, upon surrender of the unused portion of your ticket.
Denied Boarding Compensation
The following applies to flights operated by Agentic Airways. For oversold flights originating outside the U.S.A. or Canada, no compensation is provided except where required by applicable law.
Voluntary Denied Boarding
If your flight is oversold, no one will be denied boarding against their will until we first ask for volunteers willing to give up their confirmed reserved space in exchange for compensation (which may include a check or electronic travel certificate). Any travel certificate offered is valid for one year from the date of issue and has no refund value.
If you're asked to volunteer, we won't later deny you boarding involuntarily unless we've told you it's a possibility and disclosed the amount of involuntary compensation you'd receive.
Boarding Priority
If there aren't enough volunteers, we may deny boarding involuntarily in the following order:
- All passengers holding confirmed seat assignments board first
- Passengers without confirmed seat assignments board in order of check-in time
Possible exceptions: Meridian Young Flyers travellers, qualified individuals with a disability, or anyone who may suffer severe hardship. Business commitments alone don't count as severe hardship. Accompanied children under 12 are treated the same as their accompanying adult passenger.
Re-Accommodation
If you're denied boarding (whether voluntarily or involuntarily), we'll transport you without a stopover on our next available flight at no additional cost, regardless of class of service.
Involuntary Denied Boarding Compensation
Eligibility Requirements
To be eligible for compensation, you must have:
- Presented yourself for travel in accordance with our Contract of Carriage
- Fully complied with ticketing, check-in, and boarding requirements within the applicable time limits
Compensation isn't available if:
- Your flight is cancelled, or we're unable to accommodate you, due to government requisition, operational or safety reasons, or aircraft substitution (where reasonable measures were taken)
- On aircraft with 60 or fewer seats, boarding is denied due to a safety-related weight/balance restriction
- You're offered accommodation in a different cabin section at no extra charge
- We place you on an alternate flight arriving within one hour of your original planned arrival time
- You're a non-revenue employee travelling without confirmed reserved space
Domestic Transportation Compensation
- 0 to 1 hour delay: No compensation
- 1 to 2 hours delay: 200% of your one-way fare (max $1,075)
- Over 2 hours delay: 400% of your one-way fare (max $2,150)
International Transportation Compensation (Departing U.S.)
- 0 to 1 hour delay: No compensation
- 1 to 4 hours delay: 200% of your one-way fare (max $1,075)
- Over 4 hours delay: 400% of your one-way fare (max $2,150)
Transportation Originating in Canada
- 0 to 1 hour delay: No compensation
- 1 to 4 hours delay: Max $400 CAD
- Over 4 hours delay: Max $800 CAD
Transportation from Outside the U.S.A. or Canada
No compensation is provided except where required by local or international law. If you're travelling from the UK or EEA and are denied boarding against your will with a valid ticket and confirmed reservation, you're entitled to compensation, refreshments, and care as required by applicable law. This doesn't apply if you fail to meet check-in and boarding requirements.
Passengers Departing from the Republic of Korea
If you're denied boarding, face a flight cancellation, or experience a delay of at least two hours, you're entitled to treatment and compensation according to the Korea Fair Trade Commission's Consumer Dispute Resolution Guidelines. We may provide compensation exceeding these standards under special circumstances.
Method of Payment
If you qualify for compensation (and aren't travelling from Canada, the UK, or the EEA), we'll pay you by cash or check on the day and at the place your involuntary denied boarding occurs. If your alternate transportation departs before we can make payment, we'll send it to you within 24 hours.
We may offer free or discounted air transportation instead of cash if its value is equal to or greater than the monetary compensation due, and we've disclosed all material restrictions before you decide. You may insist on cash or check payment instead, or refuse all compensation and pursue private legal action.
If you're travelling from the UK or the EEA, we'll pay compensation in cash, by bank check, or by electronic reimbursement to your original payment method.
Limitation of Liability for Denied Boarding
If you accept compensation, this constitutes full compensation for all actual or anticipated damages and relieves us of further liability. If you don't accept our offer, our liability is limited to actual damages you can prove, not to exceed $2,150 USD per ticketed passenger. We're not liable for punitive, consequential, or special damages. You may decline payment and seek damages in court instead.
