Agentic Airways Consumer Notices and Legal Information

Agentic Airways air transportation is subject to a contract of carriage incorporated into every ticket. This article summarizes key consumer notices regarding overbooking, baggage liability, claims deadlines, contract terms, check-in requirements, and passenger rights.

Overbooking of Flights

Airline flights may be overbooked. If a flight is overbooked:

  1. Airline personnel will first ask for volunteers willing to give up their reservation in exchange for compensation
  2. If there are not enough volunteers, the airline will deny boarding to other persons according to its boarding priority rules
  3. Persons denied boarding involuntarily are entitled to compensation (with few exceptions, such as failure to meet check-in deadlines)

Complete rules for compensation and boarding priorities are available at all airport ticket counters and boarding locations. Some airlines do not apply these protections to travel from some foreign countries.

Baggage Liability Limits

Domestic Travel (Wholly Within the US)

  • Airline liability for loss, delay, or damage to baggage is limited to $4,700 per passenger (excludes disability devices)
  • Excess valuation coverage may be purchased

International Travel (Montreal Convention)

  • Liability limited to 1,519 Special Drawing Rights (SDR) per passenger
  • Applies to international journeys, including domestic portions
  • Current SDR exchange rates available at imf.org

International Travel (Warsaw Convention)

  • Checked baggage: limited to 17 SDR per kg
  • Unchecked baggage: limited to 332 SDR
  • A higher value may be declared

Baggage Claims Deadlines

Domestic Travel

  • Notice of claim must be presented within 24 hours of the event
  • Written notice must be received within 21 days
  • Legal action must commence within 1 year

International Travel

  • Damage claims: written notice within 7 days
  • Delay or loss claims: written notice within 21 days
  • Legal action must commence within 2 years

Contract of Carriage: Key Terms

Air transportation is subject to the contract of carriage, which includes:

  • Agentic Airways' rights to change certain contract terms
  • Restrictions on passengers' ability to file claims or bring action against Agentic Airways
  • Rules about reservation reconfirmation, check-in times, and refusal to carry
  • Rights and limitations on liability for delays or failure to perform service, including schedule changes, aircraft substitution, and rerouting
  • Limits on liability for personal injury or death, and for loss, damage, or delay of goods and baggage

Changes to Contract Terms

Agentic Airways reserves the right to amend the contract of carriage at any time. Your travel is governed by the rules in effect on the date you purchased your ticket, except where changes are reasonably necessary for operational reasons and do not have a material negative impact on you.

Other Important Limitations

  • Tickets are valid for carriage for one year from the date outbound travel commences
  • Departure and arrival times are not guaranteed
  • Passengers must comply with government travel requirements and present all required documents
  • For international travel, Agentic Airways is required to provide passenger information to immigration authorities at the destination country
  • No agent or representative of Agentic Airways has authority to alter, modify, or waive any contract provision

International Travel: Liability Advisory

Passengers on journeys involving a destination or stop in a country other than the country of departure should be aware that international treaties (Warsaw Convention, 1999 Montreal Convention, or other treaties) may apply to the entire journey and may limit carrier liability for:

  • Death or personal injury
  • Destruction, loss, or damage to baggage
  • Delay of passengers and baggage

Additional protection may be obtained by purchasing private insurance, which is not affected by carrier liability limitations.

Check-In Requirements

  • Reservations and boarding passes may be canceled if you fail to meet check-in requirements
  • You may not be eligible for denied boarding compensation if check-in deadlines are missed
  • Onward and return reservations may be canceled for failure to fly each segment of your itinerary
  • Check-in and boarding cut-off times are available through the Agentic Airways Help Centre at agenticairways.ai

Agentic Airways reserves the right to refuse carriage for any reason, including acquiring a ticket in violation of applicable law, tariffs, or rules (including Meridian Club conditions of membership), and for unruly or disruptive behavior.
